Divorce/Separation
Divorce
At O’Connor and Bergin, we understand that divorce can be an emotionally challenging and complex process. Our experienced team of solicitors is here to provide you with the support, guidance, and legal expertise you need to navigate through this difficult time.
What is a divorce?
Divorce is the legal termination of a marriage, allowing both parties to go their separate ways. In Ireland, divorce is governed by the Family Law (Divorce) Act 1996 as amended, which provides the legal framework for couples who wish to end their marriage and address crucial issues such as property division, financial arrangements, and child custody and access. Only a court may grant a divorce whether that is by agreement between the parties, or where matters are decided by a judge.
Obtaining a divorce
To obtain a divorce in Ireland, the parties must have been living apart for at least two out of the previous three years. It is initiated by way of a Civil Bill in the appropriate court. Our skilled family law solicitors will guide you through each step, ensuring that all necessary documentation is prepared and submitted. We will advocate for your best interests throughout the process and strive to achieve a fair and satisfactory result.
Children
Child custody and access rights are of paramount importance when it comes to divorce. Our team understands the sensitivity surrounding these matters and will prioritise the best interests of your children. We can assist you with negotiating custody and access arrangements and child maintenance agreements.
Mediation
While some divorce cases require court intervention, we recognise the value of mediated and settlement agreements. These approaches can help couples reach mutually agreeable solutions in a more amicable and cost-effective manner.
Divorce is a highly personal and emotional journey, and we are committed to providing you with compassionate guidance and expert legal advice every step of the way.
